User Agreement

LEARN NC User Agreement 1. Limited License 2. User Indemnity 3. Acceptable Use Policy 1. LIMITED LICENSE Subject to payment of any applicable course registration fees as specified on the LEARN NC web site, LEARN NC grants to the User a limited, non-transferable license to access and use course content on the LEARN NC server for the duration of the course and not to exceed 60 days upon the end of the course as specified by the course instructor. LEARN NC shall have access to all courses hosted on its servers and can access such content for administrative or technical purposes at any time. The content of LEARN NC courses is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. You may download those portions of the course content as directed by the course instructor. You may make printed copies of these downloadable content items for your personal course work only. You may not make additional copies of any CDs, video tapes, audio tapes, or other present or future technological course supplements. 2. USER INDEMNITY I, the User, agree to indemnify, defend, and hold harmless LEARN NC, its directors, employees, and agents, and the University of North Carolina at Chapel Hill from and against any and all liabilities, claims, suits, losses, damages, costs, fees, and expenses brought against or incurred by LEARN NC that arise from or relate to any claim or action alleging: (a) Use of LEARN NC Intellectual Property or the Intellectual Property of other LEARN NC Users without the authorization of LEARN NC; (b) A school system's or User's conduct of their business outside the scope of the content originally provided by LEARN NC; (c) A school system's or User's negligence or willful misconduct; (d) That any material a local school system or User provides to LEARN NC infringes upon or misappropriation of any patent, trade secret, copyright, trademark, or or right or interest of a third party, which right arises under the law of the United States or under the law with regard to the same subject matter of another country with which the United States is a co-signer of a treaty with respect ot such law; (e) Violation by a local school system or User of the Children's Online Privacy Protection Act or the Family Education Rights & Privacy Act (FERPA); or (f) A tortuous act or omission of a local school system or User. 3. LEARN NC ACCEPTABLE USE POLICY I. Guidelines for Acceptable Use Acceptable use covers the range of behaviors appropriate for all LEARN North Carolina online courses and any additional components facilitated by LEARN NC but not hosted on LEARN NC servers. Uses that harm others or damage their property are socially unacceptable; some socially unacceptable uses may also violate state and/or federal laws. Some examples of this unacceptable use include, but are not limited to the following: a. Deleting, copying, modifying, or forging others emails or homework b. Accessing others email without their permission c. Damaging computer equipment, files, data or the network d. Using profane, abusive, or impolite language e. Disguising one's identity, impersonating other users, or sending anonymous email messages f. Threatening, harassing, or making false statements about others g. Accessing, transmitting, or downloading offensive or harassing, materials h. Accessing, transmitting, or downloading computer viruses or other harmful files, or in any way degrading or disrupting any computer system performance i. Accessing or downloading large files j. "Hacking" or attempting to access information that is protected by privacy laws II. Penalties for Improper Use The improper use of a LEARN NC email account and/or the any area of Blackboard may result in removal from the course without refund from LEARN NC or cancellation of the LEARN NC account. Inappropriate use may lead to disciplinary and/or legal action.

Drop Policy

If your course has Registration Fee, LEARN NC will email an invoice to you two weeks prior to the start date of the course. Please note that payment is due on the 5th day of the course. If payment or a purchase order for the invoice is not submitted to LEARN NC by the 5th day, you will be dropped from the course on that day. If you wish to drop the course, you must notify the Registrar in writing at pdcourseregistration@learnnc.org within 5 days of the scheduled course start date. If we do not receive written notification of your drop, you will be CHARGED for the course. Please note that not completing the course satisfactorily is considered a withdrawal and will result in being charged for the course if after the 5th day.
